1. The Marketplace
TeeBox, Inc. ("TeeBox," "we," "us") operates an online marketplace at teeboxmarket.com that allows registered users ("members") to list, buy, and sell golf-related goods. TeeBox is not the seller of any item listed on the platform, does not own or take possession of items, does not authenticate or inspect items, and is not party to the contract of sale between any buyer and seller.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract. By using the service, you confirm that you meet these requirements.
3. Listings
Sellers are solely responsible for the accuracy of their listings, including descriptions, photos, condition, ownership, and the legality of selling the item. Counterfeit, stolen, or misrepresented items are prohibited and will result in suspension and possible referral to law enforcement.
4. Buyer Responsibility
Buyers should examine listings carefully and use the in-app messaging to ask questions before purchasing. All items are sold "as-is" by the seller. TeeBox makes no representation or warranty regarding the condition, authenticity, value, or suitability of any item. Buyers assume the risk of any transaction.
5. Payments & Fees
Payments are processed by Stripe, Inc. TeeBox charges sellers a 8.5% transaction fee on each completed sale, deducted from the payout. There are no fees for buyers or for listing items. Fees may change with 30 days' notice.
6. Shipping & Delivery
Sellers must ship sold items within 3 business days using a tracked, insured carrier. Risk of loss passes to the buyer upon delivery to the carrier. Disputes about lost or damaged items must be pursued first with the carrier and the seller.
7. Disputes & Refunds
If you have a problem with a transaction, contact the other party first via in-app messaging. If you cannot resolve it, contact support@teeboxmarket.com within 7 days of the delivery date. TeeBox may, at its discretion, mediate, refund, or remove a member from the platform, but is not obligated to do so and is not financially liable for losses arising from a transaction.
8. Prohibited Conduct
You agree not to: (a) post counterfeit, stolen, or illegal items; (b) use the platform to circumvent the in-app payment system or to facilitate off-platform sales; (c) harass other members; (d) probe, scan, or attempt to compromise the security of the service; (e) use the service for any unlawful purpose.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEEBOX, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRANSACTION. TEEBOX'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID TO TEEBOX IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (ii) USD $100.
10. Indemnification
You agree to indemnify and hold harmless TeeBox from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your listings or transactions, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
11. Suspension & Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time by contacting support@teeboxmarket.com.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the platform. Continued use of the service after a change constitutes acceptance.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the service will be brought exclusively in the state or federal courts of Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
